Terms of Service

1. Definitions
1.1 "Seller" refers to Barratt & Maxine, the entity offering products for sale on the website.
1.2 "Buyer" refers to any person or entity purchasing products from the Seller.
1.3 "Products" refers to all items offered for sale by the Seller.
1.4 "Website" refers to the Seller's online platform at www.barrattandmaxine.com.

2. Applicability
2.1 These General Conditions apply to all offers, orders, and agreements between the Seller and the Buyer unless explicitly agreed otherwise in writing.
2.2 By placing an order, the Buyer agrees to these conditions.

3. Orders and Agreements
3.1 All orders placed via the Website are subject to acceptance by the Seller.
3.2 The Seller reserves the right to refuse orders without providing a reason.
3.3 An agreement is formed when the Seller confirms the order in writing or dispatches the Products.

4. Prices and Payment
4.1 All prices on the Website are in Euros and include 21% VAT, as indicated.
4.2 The Seller reserves the right to adjust prices due to changes in VAT, exchange rates, or supplier costs.
4.3 Payment must be made via the methods offered on the Website. Orders will only be processed after full payment is received.

5. Delivery
5.1 The Seller will make reasonable efforts to deliver Products within the specified timeframe. However, delivery times are estimates and not guarantees.
5.2 Risk of loss or damage passes to the Buyer upon delivery.
5.3 If delivery is delayed or impossible, the Seller will inform the Buyer promptly. In such cases, the Buyer may cancel the order and receive a refund.

6. Right of Withdrawal
6.1 The Buyer has the right to withdraw from the purchase within 14 days of receiving the Products without giving a reason.
6.2 To exercise this right, the Buyer must notify the Seller in writing and return the Products in their original condition and packaging at the Buyer’s expense.
6.3 The Seller will refund the purchase price within 14 days of receiving the returned Products.

7. Warranty and Complaints
7.1 The Seller warrants that the Products conform to their description on the Website and meet the reasonable expectations of quality, reliability, and usability.
7.2 The Buyer has rights under statutory warranty, meaning the Products must meet the reasonable expectations based on the type of product. If a Product fails to meet these expectations, the Buyer is entitled to repair, replacement, or a refund, depending on the circumstances.
7.3 Any defects must be reported to the Seller within 14 days of discovery.

8. Liability
8.1 The Seller’s liability is limited to the value of the order.
8.2 The Seller is not liable for indirect or consequential damages, including loss of profits, except in cases of gross negligence or intent.
8.3 The Seller is not responsible for the proper installation of the lighting products. The Buyer is advised to ensure that the installation is carried out by a qualified and experienced electrician. Incorrect installation may pose safety risks and void warranties.

9. Privacy
9.1 The Seller respects the Buyer’s privacy and processes personal data in accordance with the Privacy Policy available on the Website.

10. Force Majeure
10.1 The Seller is not liable for delays or non-performance caused by events beyond its reasonable control, including natural disasters, strikes, or government actions.

11. Governing Law and Disputes
11.1 These conditions are governed by Dutch law.
11.2 Disputes will be submitted to the competent court in The Netherlands.

12. Amendments
12.1 The Seller reserves the right to amend these conditions. Updates will be posted on the Website and apply to orders placed thereafter.
